In these terms and conditions, “we” “us” and “our” refers to Hillman Meat Company, a trading name of Freud Pty Ltd. Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions.This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://www.hillmans.com.au.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. 

We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.

Intellectual Property Rights

The Site (hillmans.com.au) and its original content, features and functionality are owned by Freud Pty Ltd. and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Web Site Services

Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.

All prices are in Australian Dollars (AUD) and are exclusive of GST. We endeavour to ensure that our price list is current. Our price list can be accessed from our home page and we reserve the right to amend our prices at any time. If you have placed an order, we undertake to fulfil your order at the price listed at the time you ordered.

Governing Law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Queensland, Australia, without giving effect to any principles of conflicts of law.

Registered Users

In order to access the services provided on this website, you must become a registered user. You must complete registration by providing certain information as set out on our membership/registration page. Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide on registration.

You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.

On registration, you will be required to provide a password. On registration you agree to pay for our services as set out on our website.

We reserve the right to terminate your registration at any time if you breach these terms and conditions.

Our services are intended to be used by registered users within Australia only.

Product Descriptions

We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate. Where we become aware of any misdescription, we reserve the right to correct any error or omission.

Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the exact look of the product you receive.

Product Orders

We supply and dispatch our products to customers within defined areas of Australia only.

We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website.

Delivery is an additional charge unless purchase criteria are met, calculated at time of purchase.

When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

Once you have submitted an order, you may not cancel that order even if our acceptance or rejection of your offer is still pending.

Delivery of your ordered products will be as set out on our website.Title of the goods passes to you when we have received payment. Our terms of payment are set out on the order page. 

All risk of loss or damage to the goods passes to you when we despatch the goods.

Before being transported all of the products you ordered are vacuum-sealed or tray packed, then packed in insulated cartons ready to be delivered to your door.

Once packed, all Hillman Meat Co produce is then transported in a refrigerated vehicle which is registered with Food Safe Queensland thus ensuring the goods meet national food safety standards and enabling us to provide you with only the highest quality products.   

Our insulated cartons  are a temporary cold-store solution.The product should be transferred to a freezer, or refrigerator as soon as possible and within four hours of delivery.

Hillman Meat Co meat is a raw product. It should be kept refrigerated until ready for consumption or, if frozen, should be defrosted in the refrigerator prior to preparation. Once the meat has been fully defrosted it should not be re-frozen and should be cooked as soon as possible. All frozen meat should be kept below -15ºC. All defrosted meat should be kept at 5ºC or below.


Hillman Meat Co product that is packaged in vacuum sealed bags can be stored safely for up to five days if the product is kept at the recommended temperature. This excludes chicken and bone-in product which can have shorter shelf lives.

We accept no responsibility for Hillman Meat Co product that has been incorrectly stored or treated contrary to the advice contained on our website and within these Terms & Conditions.

Order Cancellation Due to Error 

Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to typographical error or similar oversight, we reserve the right to cancel a transaction. Where your credit card has been charged, we will immediately refund your credit card for the total amount debited.

Product Returns

We undertake to replace any product delivered to you that is faulty or is in a damaged condition. If you wish to return a faulty or damaged product, you must notify us through our designated “contact us” webpage. 

If we are unable at the time of return to replace or exchange returned goods, we undertake to reimburse your credit card for the amount initially debited for the purchase including packaging and delivery charges.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately. 

Privacy Policy

We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information that you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.

Refund Policy

Meat purchased on hillmans.com.au comes with the following guarantee: Regardless of anything in these Terms and Conditions, you are entitled to a replacement or refund directly from Hillman Meat Company
 
If for any reason you have received an incorrect item, your whole order has not been delivered, incorrect item/s were delivered or you have received something that you are not 100% satisfied with, we will ensure that you are not charged. However you must notify Hillman Meat Company via phone within 12 hours of the delivery being made, and we may need you to provide proof of the issue. We are not able to refund any consumed or disposed of items. It may take up to 7 days to process a credit to your account. 

Limit of Liability

If you are not a consumer within the meaning of the Australian Consumer Law then this clause applies to you. If you are a consumer within the meaning of the Australian Consumer Law then this clause has no effect whatsoever to in any way limit our liability or your rights. If you are not a consumer:-

Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.

To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded. 

We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

From time to time we may host third party content on our website such as advertisements and endorsements belonging to other traders. Responsibility for the content of such material rests with the owners of that material and we are not responsible for any errors or omissions in such material.
